Agreement to Terms

Welcome to 0xCal! These Terms of Service ("Terms") govern your use of the 0xCal mobile application ("App") operated by Bartek Pichalski ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

0xCal is a calorie tracking and nutrition management application that helps you:

• Track daily calorie intake and nutritional information
• Log food entries using text descriptions or photos
• Receive AI-powered nutritional estimates
• Monitor health metrics via Apple HealthKit integration
• Set and track dietary goals

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms.

If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Account and User Responsibilities

Your Responsibilities

You agree to:

• Provide accurate information during setup
• Use the App only for personal, non-commercial purposes
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App to transmit harmful, illegal, or inappropriate content
• Not abuse or exploit any bugs, glitches, or vulnerabilities
• Keep your device secure and protected

Acceptable Use

You may NOT use the App to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or interfere with the App's operation
• Attempt to gain unauthorized access to our systems
• Use automated systems or bots to interact with the App
• Circumvent rate limiting or usage restrictions

Health and Medical Disclaimer

Nutritional Estimates

• The nutritional information provided by our AI is an estimate only
• Actual nutritional values may vary significantly based on portion sizes, preparation methods, and ingredient variations
• Do not rely solely on the App for making dietary decisions that could impact your health

Not Medical Advice

• The App does not provide medical advice
• Always consult a qualified healthcare provider or registered dietitian before making significant dietary changes
• If you have diabetes, eating disorders, or other health conditions, consult your doctor before using the App

HealthKit Data

• Health data from HealthKit is provided for informational purposes only
• The App is not a substitute for professional medical monitoring
• Report any health concerns to your healthcare provider

AI-Powered Features

AI Nutritional Analysis

The App uses artificial intelligence to analyze food descriptions and images. You understand that:

• AI estimates are approximate and may contain errors
• Results depend on the quality and accuracy of your input
• AI systems have inherent limitations and biases
• You should verify important nutritional information independently

Content You Submit

When you submit food descriptions or images for AI analysis:

• Your content is processed by third-party AI services
• We do not claim ownership of your content
• You grant us a limited license to process your content for the purpose of providing the service
• Images are processed and not permanently stored on our servers

Subscription and Payments

0xCal Unlimited

We offer a premium subscription ("0xCal Unlimited") with additional features. By subscribing, you agree to:

• Pay the applicable subscription fees
• Allow automatic renewal unless cancelled before the renewal date
• Accept Apple's App Store terms for in-app purchases

Pricing and Billing

• Prices are displayed in the App and may vary by region
• Payment is processed through Apple's App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

Cancellation and Refunds

• You can cancel your subscription at any time through your Apple ID settings
• Refunds are handled according to Apple's App Store refund policy
• No refunds are provided for partial subscription periods
• Upon cancellation, you retain access until the end of your current billing period

Free Trial

If offered:

• Free trials automatically convert to paid subscriptions unless cancelled
• One free trial per Apple ID
• Cancel before the trial ends to avoid charges

Intellectual Property

Our Rights

The App and its original content, features, and functionality are owned by us and are protected by:

• Copyright laws
• Trademark laws
• Other intellectual property rights

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal device
• Use the App for personal, non-commercial purposes

This license does NOT include the right to:

• Modify, copy, or distribute the App
• Use the App for commercial purposes
• Sublicense or transfer your rights
• Remove any copyright or proprietary notices

User Content

You retain ownership of any content you create within the App (food logs, notes, etc.). However, you grant us a limited license to use this content as necessary to provide the service.

Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Disclaimers

"As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT

Service Availability

We do not guarantee that:

• The App will be available at all times
• The App will be error-free or uninterrupted
• Defects will be corrected
• The App or servers are free of viruses or harmful components

AI Accuracy

We do not warrant that AI-generated nutritional estimates are accurate, complete, or reliable.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any damages arising from your reliance on nutritional information provided by the App

This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.

Indemnification

You agree to indemnify and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the App

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by:

• Posting updated Terms in the App
• Updating the "Last Updated" date

Your continued use of the App after changes constitutes acceptance of the new Terms.

Termination

By You

You may stop using the App at any time by:

• Deleting the App from your device
• Cancelling any active subscriptions

By Us

We may terminate or suspend your access to the App at any time, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the service
• Any other reason at our sole discretion

Effects of Termination

Upon termination:

• Your license to use the App ends immediately
• You lose access to premium features (if subscribed)
• We may delete your data from our servers
• Provisions that should survive termination will remain in effect

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved in the courts of Poland.

Dispute Resolution

Informal Resolution

Before filing any legal claim, you agree to try to resolve the dispute informally by contacting us at support@0xcal.app. We will attempt to resolve the dispute within 30 days.

Arbitration

If informal resolution fails, any dispute shall be resolved by binding arbitration, except that you may assert claims in small claims court if eligible.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
